When you and your company are enrolled in the Everything Is Transit DOT Consortium, your company will receive a Certificate of Compliance and when any of your drivers or other safety sensitive employees are selected for a Random Test, The Designated Employer Representative (DER) or you, the independent operator will be sent a phone call and a email will be made to ensure that you and your employee(s) are aware of the selection, provided the closest testing center location and any assistance needed to ensure compliance with the DOT Random Drug or Alcohol Test process.

Everything Is Transit (EIT) serves as a Consortium / Third Party Administrator (C/TPA) which manages the entire DOT approved Consortium for DOT regulated companies and DOT covered safety sensitive employees. The DOT consortium is cost effective and complies with all requirements of DOT 49 CFR Part 40 which mandates that all safety sensitive employees be enrolled in a random drug and alcohol testing program.
The Department of Transportation (DOT) has strict regulations requiring regulated companies and independent operators (CDL License Holders) be a member of a DOT drug and alcohol Consortium, failure to comply with these regulations can result in significant fines and other DOT sanctions.
Everything Is Transit Consortium ensures compliance with the DOT regulations and customer service is our number one priority. Our DOT specialist are committed to serving our DOT consortium members in need of a pre-employment drug test, random drug test or breath alcohol test.
A DOT drug test is a 5 panel urine test and all DOT drug tests require a Federal Chain of Custody form, this is a special 5 page form which must be used when a DOT drug test is administered.  

Consortium enrollment memberships are offered. Selections are made quarterly and if selected, you are notified by phone/email and provided a testing location. Upon enrollment, you will receive a certificate of compliance for submission to DOT and all memberships receive MIS reporting. Additional services include DOT Drug Testing, DOT Physicals, MVR reports and FMCSA Clearinghouse registration assistance.

Federal Motor Carrier Safety Administration (FMCSA) Testing

All employers regulated by 49 CFR Part 382.305 are required to implement a Random Drug and Alcohol Testing program. All safety sensitive employees such as CDL drivers must be randomly tested throughout the year and an employer who employs only himself/herself as a driver who is not leased to a motor carrier, shall implement a random testing program of two or more covered employees in the random testing selection pool as a member of a consortium/random testing pool. We specialize in DOT Random Drug and Alcohol Testing programs for single owner operators with small, medium and large trucking companies with multiple drivers.

The current rate for FMCSA random drug and alcohol testing is:

  • 50% Driver positions for Controlled Substances (5 panel DOT urine)
  • 10% Driver positions for (BAT) Breath Alcohol Testing

Federal Transit Administration (FTA) Random Testing

Employers who are covered under 655.21 Drug testing regulations for the Federal Transit Administration must implement a random drug and alcohol testing program that ensures the selection of employees for random drug and alcohol testing is made by a scientifically valid method, such as a random number table or a computer-based random number generator that is matched with employees' Social Security numbers, payroll identification numbers, or other comparable identifying numbers. Under the selection process used, each covered employee shall have an equal chance of being tested each time selections are made. FTA regulated employers must also ensure that the number of employees randomly selected and tested during each calendar year to equal an annual rate not less than the minimum annual percentage rates for random drug and alcohol testing determined by the FTA Program Administrator.
If the employer conducts random drug and alcohol testing through a consortium, the number of employees to be tested may be calculated for each individual employer or may be based on the total number of covered employees covered by the consortium who are subject to random drug and alcohol testing at the same minimum annual percentage rate under this part.
Random testing must be unannounced and unpredictable, and that the dates for administering random tests are spread reasonably throughout the calendar year and random testing must be conducted at all times of day when safety-sensitive functions are performed.
When a covered employee is notified of selection for random drug or random alcohol test, they must proceed to the test site immediately.

The FTA Defines safety sensitive covered employees as:

  • A person who performs a revenue vehicle operation.
  • revenue vehicle and equipment maintenance.
  • revenue vehicle control or dispatch (optional);
  • Commercial Driver's License non-revenue vehicle operation; or
    armed security duties.

The current rate for FTA random drug and alcohol testing is:

  • 10% Alcohol
  • 50% Drugs

Federal Railroad Administration (FRA) Random Testing

Each Federal Railroad Administration (FRA) regulated employer covered by 49 CFR Part 219.601 and 219.607 must to the greatest extent possible ensure that its FRA random testing program is designed and implemented so that each employee performing regulated service on its behalf should reasonably anticipate that he or she may be called for a random test without advance warning at any time while on duty and subject to performing regulated service.
Furthermore, each railroad as required by 219.603 through 219.609, must submit for FRA approval a random testing plan meeting the requirements of this subpart prior to conducting random testing.
The plan must address all safety sensitive regulated employees, as defined in 219.5.

Regulated employees defined as:

A person who performs covered service (subject to hours-of-service laws) functions at a rate sufficient to be placed into the railroad's random testing program. Categories Include:

  • Locomotive Engineers
  • Trainmen, Conductors
  • Switchmen, Locomotive Hostlers/Helpers
  • Utility Employees
  • Signalmen
  • Operators
  • Train Dispatchers

In addition, a person who performs a maintenance-of-way/roadway worker function (as defined in 49 CFR Part 214) who are employees or contractors of a railroad, have a potential to foul the track, and perform a regulated function such as inspection, construction, maintenance or repair of railroad track, bridges, roadway, signal and communication systems, electric traction systems, roadway facilities or roadway maintenance machinery on or near track, as well, flagman and watchmen/lookouts.

The current rate for FRA random drug and alcohol testing is:

25% - Drug Covered Service

10% - Alcohol Covered Service

25% - Drug Maintenance of Way

10% - Alcohol Maintenance Of Way

50% - Drug Mechanical

25% - Alcohol Mechanical

Pipeline and Hazardous Materials Safety Administration (PHMSA) Random Testing

Employers regulated his part requires operators of pipeline facilities subject to part 192, 193, or 195 of this chapter to test covered employees for the presence of prohibited drugs and alcohol. Each operator/covered employer must maintain and follow a written anti-drug plan that conforms to the requirements of this part and the DOT Procedures. which outlines specific requirements as required by 199.101 Anti-drug plan and 199.202 Alcohol misuse plan.
Random testing must be conducted by a scientifically validated method ensuring that all covered/safety sensitive employees have an equal chance of being selected for testing.

PHMSA defines covered service as:

  • A person who performs on a pipeline or liquefied natural gas (LNG) facility an operation,
  • maintenance, or
  • emergency-response function.

The current rate for PHMSA random drug and alcohol testing is:

  • 50% drugs
  • Alcohol N/A

Additional companies/operators subject to DOT Drug & Alcohol Testing

  • If you or your company operate vehicles with a gross weight rating of 26,001 or more pounds
  • If you or your company operate vehicles which can transport 16 or more passengers. (including the driver)
  • If you or your company operate vehicles which transport hazardous materials.

DOT Random Drug & Alcohol Testing

The Department of Transportation (DOT) requires that all covered employees be enrolled in a DOT approved Random Consortium Selection Program. The selection of any covered employee must be made by a computerized selection process and any covered employee selected for a drug and alcohol test must immediately proceed to take the test once notified.
The Department of Transportation (DOT) determines the percentages that each consortium must select for a drug & alcohol test. As an example the FMCSA Consortium must select 50% of its members for a drug test quarterly and 10% for an alcohol test.
Everything Is Transit DOT random drug testing program notifies covered employees by email and a phone call and provides the location of the closest testing center for the covered employee to go and take their drug and alcohol test.
Failing to take a random drug or alcohol test once selected can result in substantial fines and penalties by the Department of Transportation (DOT).

DOT Post Accident Drug & Alcohol Testing
The Department of Transportation (DOT) requires that any covered employee immediately proceed to take a drug and breath alcohol test in the event of an accident which falls under the DOT post accident drug and alcohol testing requirements.
When possible the covered employee can contact Everything Is Transit and the drug and alcohol test can be conducted at a testing center close to where the accident occurred, however on many occasions a post accident drug and alcohol test will require an on-site/mobile drug testing service which can be provided by Everything Is Transit. DOT Drug & Alcohol Policy
The Department of Transportation (DOT) requires that any regulated company with two or more employees holding safety sensitive positions covered by 49 CFR Part 40 must have a written DOT Drug & Alcohol Policy and all employees must be provided a copy of the policy. Companies must comply with all requirements listed in the DOT drug and alcohol policy.

DOT Consortium Employee Revisions
Quarterly each consortium member will be contacted by the Everything Is Transit, DOT specialist and asked to update the company's DOT Consortium employee list, prior to the random selection draw (add or remove employees from the consortium). Companies can remove or add employees to the consortium prior to the selection date. Maintaining an accurate consortium list is an important service provided by Everything Is Transit and requires the cooperation of all Consortium Members.DOT Additional Requirements/Information.
The Department of Transportation only recognizes and authorizes a 5 panel urine drug test and a breath alcohol test for compliance with 49 CFR Part 40.
The Department of Transportation (DOT) requires that a Federal Chain of Custody Form (5 Page CCF) be used with all drug screens and that all breath alcohol testing devices be approved by the DOT.
